For consideration that I acknowledge, I have provided to Vista Health Pte. Ltd (“VH”) certain information and materials (“Content”) as further described in Attachment 1.

I hereby consent to VH’s and VH’s affiliates’ and agents’ right to record my image and likeness (together “Image”) in any and all media (“Recordings”).

I understand and agree that my Content and the Recordings may be used in connection with any of VH’s commercial or non-commercial purposes including, without limitation, its presentations, press conferences, printed publications, promotional materials, websites, testimonials about VH products, and in the advertising of VH's and its affiliates’ goods or services, throughout the world. To the extent that any personal information of mine is included in such Content and/or Recordings, I acknowledge that VH’s use is within its legitimate business interests. These legitimate business interests include VH’s right to market its products and services.

I further understand that my personal information may be transferred to and stored in Singapore where the level of protection may be lower than in my country. Such transfers may be within the VH group or to selected third party service providers that support VH’s business. Where allowed for by law, I have the right at any time to withdraw my consent to use and reuse my personal information as incorporated into the Recordings and Materials, and, after such date, VH, its affiliates, licensees, agents, successors and assigns will not incorporate any such personal information in any new Materials produced pursuant to this release. The withdrawal of consent can be effected in writing or other documented format, for example by sending an email to limmx@vistahealthconsulting.com.

I understand that any of my personal information will be retained by VH for as long as is necessary in connection with the purposes for which it was collected (as set out above), and that it will always be used in accordance with VH’s data retention policies and applicable national law.

I hereby waive any right that I may have to inspect and/or approve of any of the uses of my Content, the Recordings, my Image or the Materials. To the extent permitted by applicable law, I, on behalf of myself and my heirs, executors, administrators, successors and assigns, hereby release and agree to hold harmless VH from any and all claims for damages arising under this consent and release.

I hereby represent and warrant to VH and its affiliates that: (a) I am at least 18 years of age or am represented by my legal guardian who is at least 18 years of age; (b) I have the right to provide the Content; (c) providing the Content does not violate any rights of any third party or policy, rule or confidentiality obligation of my employer or any other third party; (d) the Content is true, correct and complete and not deceptive or misleading; and (e) the Content is an accurate representation, and any testimonial provided as part of the Content reflects my honest opinions, findings, beliefs or experiences.

Adverse Events

We are required to pass on to our client details of adverse events that are raised during the course of market research. Although this is an online market research study and how you will respond will, of course, be treated in confidence, should you raise an adverse event in a specific patient we will need to report this, even if it has already been reported by you directly to the company or the regulatory authorities.

In such a situation you will be contacted to ask whether or not you are willing to waive the confidentiality given to you under the market research codes of conduct specifically in relation to that adverse event. Everything else you say during the course of the study will continue to remain confidential.
